Buying Land Safely in Kenya: The Standard 5-Step Verification Protocol
Land fraud is a real concern in Kenya. At Sakina Property's Solution LTD, we advise every buyer to follow an independent verification procedure before paying any deposit.
Conduct an Official Search at the Land Registry (or Ardhisasa)
Using a copy of the Certificate of Title or Title Deed provided after your site visit, conduct an official search at the relevant Ministry of Lands registry (Nairobi, Machakos, or Kajiado) or via the online Ardhisasa platform. An official Certificate of Search confirms the true registered proprietor, the exact parcel acreage/hectarage, and whether any bank charges, caveats, cautions, or court restrictions exist against the title.
Confirm the Seller's Identity & Authority to Sell
Ensure the person or company selling the land matches the registered proprietor shown on the official search. For corporate sellers, your advocate should obtain an official Registrar of Companies search (Form CR12) to verify the current directors and shareholders, and confirm a valid board resolution authorizing the sale.
Check County Land Rates & Land Rent Clearance
For urban and leasehold properties (in Nairobi County, Mavoko/Machakos County, or Kajiado County), verify that annual County Land Rates and Ministry of Lands Ground Rent have no unpaid arrears or penalties. A valid Rates Clearance Certificate and Land Rent Clearance Certificate are mandatory completion documents prior to title transfer.
Visit the Site in Person With a Licensed Surveyor
Never rely solely on marketing flyers or unverified sketches. Obtain the Registry Index Map (RIM) or Deed Plan from Survey of Kenya and visit the physical parcel with a qualified surveyor. Measure the dimensions on the ground, locate every concrete corner beacon, and confirm that the parcel does not encroach onto road reserves, riparian buffers, railway corridors, or high-voltage power wayleaves.
Use a Qualified Advocate for the Sale Agreement & Completion
Engage a licensed Advocate (verifiable on the Law Society of Kenya portal) to draft or review the Law Society Conditions of Sale agreement, structure stakeholder deposit holding, verify Land Control Board (LCB) consent or spousal consent where applicable, oversee stamp duty valuation, and register the transfer in your name.
